XDMA Terms of Service
1. Acceptance of Terms
By accessing or using the XDMA website at https://xdma.net or purchasing any products or services from XDMA, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree with any provision of these terms, you must immediately cease using our website and services.
These Terms of Service constitute a legally binding agreement between you and XDMA. We reserve the right to modify these terms at any time with thirty (30) days written notice posted on our website. Your continued use of our services after any modifications indicates your acceptance of the revised terms.
2. Business Description and Scope
XDMA operates as a legitimate digital marketplace specializing in the resale of software license keys for Field-Programmable Gate Array (FPGA) development and research applications. We operate under authorized distribution agreements with recognized software publishers and maintain documented authorization for all products we sell.
Our business focuses exclusively on supporting legitimate FPGA development, scientific research, hardware acceleration applications, signal processing tools, and authorized commercial software development. We maintain strict policies against facilitating any prohibited activities and operate in full compliance with payment processor acceptable use policies and applicable laws.
Authorization Verification: All software licenses are obtained through documented agreements with software publishers. Customers may request verification of our authorization status for any product by contacting admin@xdma.net. We maintain public records of our distribution partnerships where permitted by our publisher agreements.
Product Authenticity: Each license key sold through our platform includes a certificate of authenticity and can be verified through the respective software publisher’s verification systems.
3. Prohibited Uses and Compliance
XDMA maintains strict compliance with all applicable laws, regulations, and payment processor requirements. The following activities are strictly prohibited and will result in immediate account termination:
Cryptocurrency and Blockchain Prohibited Uses: Customers may not use any software purchased through our platform for cryptocurrency mining, blockchain validation, digital currency generation, or any related financial activities without explicit written authorization from both XDMA and the software publisher.
Illegal Activities: Any use of our services or purchased software for illegal purposes, unauthorized access to computer systems, malicious software development, or any activities that violate applicable laws or regulations is strictly prohibited.
Export Control Compliance: Customers must comply with all applicable export control laws and regulations. Software containing encryption or dual-use technology may be subject to export restrictions. Customers are responsible for obtaining any required export licenses.
Financial Services: We do not provide or facilitate any financial services, money transmission, lending, credit services, or investment activities. Our business is limited exclusively to software license sales for legitimate development purposes.
4. Data Protection and Privacy Compliance
XDMA complies with the General Data Protection Regulation (GDPR), UK Data Protection Act 2018, and other applicable privacy laws. We process personal data in accordance with our Privacy Policy, which forms part of these Terms of Service.
Customer Rights: EU and UK customers have rights including access, rectification, erasure, and portability of their personal data. Contact admin@xdma.net to exercise these rights.
Data Retention: We retain transaction records and customer data as required by applicable laws and our legitimate business interests, typically for seven (7) years after account closure.
5. Eligibility and Registration
Our services are intended exclusively for individuals and businesses who are eighteen years of age or older and possess the legal capacity to enter into binding agreements. Business customers must provide valid commercial registration details.
Customer Verification: We may require additional documentation to verify customer identity and intended use, including business registration certificates, professional licenses, or institutional affiliations.
You agree to provide accurate, current, and complete information during registration and to maintain the accuracy of such information. You are solely responsible for maintaining the confidentiality of your account credentials.
6. Refund Policy – Digital Products
Limited Refund Circumstances: While digital license keys are generally non-refundable due to their immediate delivery and permanent value, we provide refunds in the following circumstances:
- Technical Defects: If a license key is technically defective or invalid, verified through publisher systems
- Compatibility Issues: If software is fundamentally incompatible with advertised system requirements
- Delivery Failure: If we fail to deliver a valid license key within 48 hours of payment
- Unauthorized Charges: In cases of unauthorized or fraudulent transactions
Refund Process: Refund requests must be submitted within 14 days of purchase to admin@xdma.net with detailed explanation and supporting evidence. Refunds are processed within 14 business days of approval.
No Refund Circumstances: No refunds are provided for change of mind, user error in product selection, or software that functions as described but doesn’t meet subjective expectations.
7. Payment Terms and Financial Compliance
All payments are processed through Stripe and other approved payment processors in compliance with applicable financial regulations. We maintain PCI DSS compliance and follow all payment industry standards.
Payment Information: You agree to provide current, complete, and accurate payment information. All prices are in GBP unless otherwise specified.
Transaction Records: We maintain detailed transaction records for seven (7) years and cooperate with payment processor compliance requirements and regulatory authorities as required by law.
8. Dispute Resolution and Customer Support
Primary Resolution: Before initiating any payment dispute or chargeback, customers must contact our support team at admin@xdma.net. We commit to responding within 48 hours and resolving legitimate issues within 14 business days.
Chargeback Policy: While we prefer direct resolution, we understand legitimate chargebacks may occur. Fraudulent or abusive chargebacks without prior communication may result in account suspension pending investigation.
Technical Support: We provide technical support for license activation and initial setup. Extended software support is provided by the original software publishers.
9. Product Delivery and Verification
Digital license keys are delivered electronically to your registered email address within 24 hours of payment confirmation. High-value or specialized products may require additional verification time.
Delivery Confirmation: All deliveries include:
- Unique license key with activation instructions
- Certificate of authenticity
- Publisher contact information for technical support
- Verification instructions for license validity
10. Intellectual Property and Third-Party Rights
The software accessed through purchased license keys is owned by respective publishers. Your use is governed by the End User License Agreements (EULAs) of those publishers.
License Compliance: Customers are solely responsible for compliance with software publisher terms, including user limitations, redistribution restrictions, and usage monitoring requirements.
11. Compliance Monitoring and Cooperation
We maintain active compliance monitoring and cooperate with payment processors, regulatory authorities, and law enforcement. We may request additional information to verify legitimate use and maintain compliance.
Publisher Cooperation: We maintain regular communication with software publishers regarding license usage and compliance matters.
12. International Compliance
Jurisdiction-Specific Terms: Customers in different jurisdictions may have additional rights under local consumer protection laws. These terms do not limit such rights where they cannot be legally waived.
EU Consumer Rights: EU customers have a 14-day cooling-off period for distance sales, subject to exceptions for digital content that has been accessed.
Export Controls: Customers must comply with all applicable export control and sanctions laws, including US EAR, UK export controls, and EU dual-use regulations.
13. Limitation of Liability and Disclaimers
Our services are provided “as is” with warranties limited to those that cannot be legally excluded. We warrant that:
- License keys are genuine and obtained through authorized channels
- Products will function as described by the software publisher
- We have authorization to sell the licenses we offer
Liability Limits: Our total liability shall not exceed the amount paid for the specific product. We are not liable for indirect, consequential, or punitive damages except where prohibited by law.
14. Account Termination and Suspension
We reserve the right to suspend accounts for policy violations, but will provide notice and opportunity to remedy violations where practical and legally required.
Immediate Termination: Immediate termination without notice may occur for: fraud, illegal activity, repeated policy violations, or activities that threaten our compliance status.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. For consumers in EU member states, mandatory consumer protection laws of their residence may also apply.
Dispute Resolution: Business customers agree to binding arbitration. Consumers retain rights to pursue claims in their local courts where provided by law.

16. Severability and Entire Agreement
If any provision is unenforceable, it will be modified to the minimum extent necessary while preserving the intent of these terms.
These Terms, together with our Privacy Policy and any additional product-specific terms, constitute the entire agreement between parties.
